Terms and Conditions for private consumers

 

These Terms and Conditions (T&C) apply to all web, tablets, phone, fax or postal orders placed by you with LEGO Company Limited, trading as LEGO Education Europe, reg. no. 368236, 33 Bath Road, Slough, Berkshire SL1 3UF (hereinafter referred to as “LEGO Education”).

Please read these T&C carefully and make sure that you understand them, before ordering any LEGO Goods.

Please note that before placing an order you will be asked to agree to these T&C (during checkout, the following will appear: “I agree to Terms and Conditions”). If you refuse to accept these T&C, you will not be able to order any LEGO Goods from us.

These T&C apply solely to private consumer transactions and shall not apply to sales to business customers. The T&C, which apply to business customers, can be found below these T&C under “Terms and Conditions for Business Customers.” Please note for the sake of clarity that schools, pre-schools, kindergartens and other educational institutions or organisations are considered “businesses”.

 

How it works

Once you have ordered and paid for your goods in the LEGO Education Shop, LEGO Education will send you an e-mail confirming details of your order and delivery, providing that you submitted an accurate e-mail address when placing your order.

If an order raises security concerns, the LEGO Group reserves the right to hold or cancel an order without a prior notice or explanation.

 

HOW WE USE YOUR PERSONAL INFORMATION

We only use your personal information in accordance with our Privacy Policy.  Please take the time to read our Privacy Policy, (URL: http://www.lego.com/en-gb/legal/legal-notice/privacy-policy-full/ ) as it includes important terms which apply to you.

 

Order Details etc

We encourage you to print or save a copy of these Conditions, your payment information for paying online and shipping confirmation e-mail immediately upon receipt, in case you need to contact us with any questions about your order. If you notice that any of the information mailed to you is incorrect please contact us immediately so we that we can correct it.

 

Prices

All prices are stated both inclusive and exclusive of all applicable taxes. The price inclusive of all applicable taxes is for your use, whereas the price exclusive of applicable taxes are solely for our business customers’ use. The price with applicable taxes is the price set out next to the product in question on the website on the date of ordering (a price excluding taxes is also stated next to the product in question). Whilst we try and ensure that all prices on our website are accurate, errors may occur. If we discover an error in the price of goods you have ordered, we will inform you as soon as possible and give you the option of reconfirming your order at the correct price or cancelling it. If we are unable to contact you, we will treat the order as cancelled. If you cancel and you have already paid for the goods, you will receive a full refund.

Delivery costs are as stipulated in the Delivery section.

 

Payment

- Credit/Debit card

We accept payment by MasterCard, Visa and Switch/Solo (UK only). Your credit/debit card will be pre-authorised for payment at the time of ordering. LEGO Education does not offer payment by invoice as an option for consumer purchases. As part of this authorisation process, your bank will place a hold on your account for the purchase amount of the order. The hold will be removed after a number of days determined by your banking institution. You will not be charged for the items until they have been shipped, unless placing a pre-order, in which instance your card will be charged up to 10 days following your order and the estimated delivery will be indicated on the item page.

The LEGO Education payment solution is based on the SSL standard, which means that your information submitted in connection with the payment transaction is protected by encryption.

Delivery

- Destinations

Delivery is only made to addresses in mainland United Kingdom. If you would like delivery to be made to any of the Islands of the UK, please contact us to see if it is possible and to get an individual quote for the delivery cost.

If no one is available at your address to take delivery, the courier will make up to two more attempts to deliver the LEGO Goods. If, after the second attempt, the courier was unable to deliver the LEGO Goods, a notice will be left on your premises requesting you to contact the courier and arrange a new delivery. If you do not contact the courier, or the courier is unable to deliver the LEGO Goods because you are not available, the LEGO Goods will be returned to a LEGO Education warehouse, in which case, please contact us to rearrange delivery.

We cannot accept orders for delivery to PO Box addresses.

 

- Delivery Times

In stock items will normally arrive within 7-10 working days (Monday to Friday, excluding public holidays). Delivery times will be confirmed on order.

- Delivery Charges for non-physical products or services

No delivery charges will apply for purchase of only non-physical products or services, e.g. digital content such as software that is either downloaded from the LEGO Education website or is a URL link that is delivered digitally via an email. You must provide an email address if ordering software. Please secure that the digital content purchased is compatible with the operating platform used by you. For more information about compatibility, please go to the ‘features & specs’ tab on the LEGO Education website, or to call Customer Service.

-       Delivery charges for physical products

Under £200 (ex. VAT) = £7.95 : Including VAT = £9.54
Over £200 (ex. VAT) = FREE : Over £240 including VAT = FREE
(Applies to UK Mainland only)

 

Any date of dispatch communicated by us shall only be an approximation and may therefore be exceeded by up to two business days, except if a fixed date of dispatch has been agreed upon.

 

- Liability for delay of delivery

LEGO Education makes every effort to deliver goods within the estimated timescales; however, delays are occasionally inevitable due to unforeseen factors. If LEGO Education does not deliver the goods within the estimated timescales you call upon LEGO Education to make the delivery within an additional period of time appropriate to the circumstances. If LEGO Education fails to deliver the goods within that additional period of time, you shall be entitled to terminate the contract.

- Liability for damage during transport

LEGO Education has the risk and liability for damage to the goods during transport when delivering until you or someone appointed by you have taken physical possession of the goods.

If you choose to return the goods regardless of the situation, you will have the risk and liability for damage to the goods during transport when returning until LEGO Education has taken physical possession of the goods.

 

Right of withdrawal

 

You have the right to withdraw from this contract within 14 days without giving any reason. The withdrawal period will expire after 14 days from the day on which you acquire, or a third party indicated by you (other than the carrier) acquires, physical possession of the goods.

If the contract relates to multiple goods ordered in one order and delivered separately, the withdrawal period will expire after 14 days from the day on which you acquire, or a third party indicated by you (other than the carrier) acquires, physical possession of the last goods.

If you withdraw from this contract, we shall reimburse you in respect of all payments received from you, including the costs of delivery (with the exception of the supplementary costs resulting from your choice of a type of delivery other than the least expensive type of standard delivery offered by us), as quickly as possible and in any event not later than 14 days from the day on which we are informed of your decision to withdraw from this contract. We will carry out such reimbursement using the same means of payment as you used for the initial transaction, unless you have expressly agreed otherwise. You will not incur any fees as a result of such reimbursement. We may withhold reimbursement until we have received the goods back or you have supplied evidence of having sent back the goods, whichever is the earliest.

The withdrawal period will expire after 14 days from the day on which you acquire, or a third party other than the carrier and indicated by you acquires, physical possession of the last goods.

To exercise the right of withdrawal, you must inform LEGO Education at the address given below of your decision to withdraw from this contract by an unequivocal statement (e.g. contacting customer services).

To meet the withdrawal deadline, it is sufficient for you to send your communication concerning your exercise of the right of withdrawal before the withdrawal period has expired.

 

- Effects of withdrawal

If you withdraw from this contract, we shall reimburse to you all payments received from you, including the costs of delivery (with the exception of the supplementary costs resulting from your choice of a type of delivery other than the standard delivery offered by us), without undue delay and in any event not later than 14 days from the day on which we are informed about your decision to withdraw from this contract. We will carry out such reimbursement using the same means of payment as you used for the initial transaction, unless you have expressly agreed otherwise; in any event, you will not incur any fees as a result of such reimbursement. We may withhold reimbursement until we have received the goods back or you have supplied evidence of having sent back the goods, whichever is the earliest. The returned goods must be substantially the same condition and quantity as delivered by LEGO Education.

- Extended right of withdrawal for physical products only

In addition to your right of withdrawal as mentioned above you can withdraw from this contract within 90 days from the day on which you acquire, or a third party other than the carrier and indicated by you acquires, physical possession of the first goods. The extended right of withdrawal begins 14 days after the day on which you acquire, or a third party other than the carrier and indicated by you acquires, physical possession of the first good. The extended right of withdrawal expires 90 days after the day on which you acquire, or a third party other than the carrier and indicated by you acquires, physical possession of the first good.

- Effects of extended withdrawal

If you withdraw from this contract using your extended right of withdrawal, we shall reimburse to you all payments received from you, excluding the costs of delivery, without undue delay and in any event not later than 14 days from the day on which we are informed about your decision to withdraw from this contract. We will carry out such reimbursement using the same means of payment as you used for the initial transaction, unless you have expressly agreed otherwise; in any event, you will not incur any fees as a result of such reimbursement. We may withhold reimbursement until we have received the goods back or you have supplied evidence of having sent back the goods, whichever is the earliest. The returned goods must be substantially the same condition and quantity as delivered by LEGO Education.

- Exceptions from the right of withdrawal

The right of withdrawal in any event does not apply to goods made to the consumer´s specification i.e. non-prefabricated goods made on the basis of and individual choice of or decision by the consumer.

Software: A right of withdrawal does not exist for sealed computer software which has been unsealed, or for digitally delivered software that has been activated/downloaded.

Any complaints will be handled by our customer service in accordance with the relevant national legislation. Please Contact Us

If any errors or defects should occur with LEGO Education products, you may claim remedy in accordance with statutory law on the sale of consumer goods.

Electronic Communications

When visiting LEGOEducation.co.uk or sending LEGO Education e-mails, you are communicating electronically with LEGO Education. LEGO Education communicates with the customer by e-mail or by posting notices on the web-site. For contractual purposes you consent to receive electronic communications from LEGO Education, and agree that all agreements, notices, disclosures and other electronic communications that LEGO Education provides satisfy any legal requirement that such communications be in writing. This clause does not affect any statutory rights you might have.

 

Liability

LEGO Education assumes no liability other than what is required by statutory legislation. LEGO Education cannot in any event be held liable for any indirect or consequential losses, including but not limited to loss of or damage to data through use of any LEGO Education web site.

Data Protection

(1) LEGO Education may save and process any data relating to you, to the extent necessary for the purpose of the execution and implementation of the sales contract and consumer and customer satisfaction surveys and as long as LEGO Education is required to keep such data in accordance with applicable law.

 

(2) LEGO Education shall have the right to submit personal data relating to you to credit agencies, to the extent necessary for a credit check, subject, however, to your consent in each individual case. LEGO Education shall not make available any personal data of you to other third parties without the express consent of you, except to the extent that a disclosure is required under applicable law.

 

(3) LEGO Education shall not be permitted to collect, submit to any third party or otherwise process personal data of you for any purpose other than those set forth in this Section.

 

Portrayal of Products

While every effort has been made to portray items accurately, slight variations may occur. All measurements quoted are approximate and the reproduction of colours is as accurate as photographic and publishing processes will allow. Please note there may be variations in colours dependant on the calibration and settings of individual screens. LEGO Education makes reservations for any typing errors which may occur on the website.

 

Children

LEGO Education does not sell products for purchase by children. Persons under 18 years of age or persons who do not possess full legal capacity may only use LEGO Education website with a supervision and involvement of a parent or guardian and may not purchase goods directly themselves.


Fair Play

Our products cannot be used for commercial purposes such as promotional campaigns, marketing and PR. Neither can we allow you to associate LEGO® parts with any other company's name or logo. Severability clause

Should any part of these Conditions be deemed unlawful and invalid and thus not enforceable, this will not affect the validity and enforcement of the remainder of the Conditions.

 

Governing law and jurisdiction

These Conditions are governed and construed in accordance with the applicable law.

Any complaints will be handled by our Customer Service team in accordance with the relevant national legislation. In the unlikely event that we cannot resolve the matter, you may use the European Commission online complaints register to submit your complaint. Terms and Conditions for business customers

 

These Terms and Conditions for Business Customers (“T&C”) apply to all web, tablet, phone, fax or postal orders for LEGO® goods and products (“LEGO Goods”) placed by you with LEGO Company Limited, trading as LEGO Education Europe, with company no. 368236, VAT number VAT Reg. No GB121472057 and registered office at Capital Point, 33 Bath Road, Slough, Berkshire SL1 3UF (hereinafter referred to as “LEGO Education”).

Please read these T&C carefully and make sure that you understand them, before ordering any LEGO Goods.

 

Please note that before placing an order you will be asked to agree to these T&C (during checkout, the following will appear: “I agree to Terms and Conditions”). If you refuse to accept these T&C, you will not be able to order any LEGO Goods from us.

 

When placing this order, you hereby confirm that you have authority to bind any business on whose behalf your purchase LEGO Goods.

 

How it works

 

(1) These T&C apply solely to business-to-business transactions and shall not apply to sales to private consumers. The T&C that apply to private consumers can be found above under Terms and Conditions for Private Consumers. Please note for the sake of clarity that schools, pre-schools, kindergartens and other educational institutions or organisations are considered “businesses”.

(2) These T&C shall exclusively apply, save as varied by express agreement accepted in writing by both parties. The offer acknowledgment, order acceptance of sale of any products covered herein is conditioned upon the terms contained in this instrument. Any conditional or different terms proposed by you are objected to and will not be binding upon LEGO Education unless assented in writing by LEGO Education.

(3) These T&C shall govern any future individual contract of sale between LEGO Education and you to the exclusion of any other terms and conditions subject to which any quotation is accepted or purported to be accepted, or any such order is made or purported to be made, by you.

(4) Any typographical, clerical or other error or omission in any sales literature, quotation, price list, acceptance of offer, invoice or other document of information issued by LEGO Education shall be subject to correction without any liability on the part of LEGO Education.

(5) Once you have ordered and paid for your goods in the LEGO Education Shop, LEGO Education will send you an e-mail confirming the details of your order and details regarding delivery, providing that you submitted an accurate e-mail address when placing your order.

(6) If an order raises security concerns, the LEGO Group reserves the right to hold or cancel an order without a prior notice or explanation.

While we try to ensure that all prices on our website are accurate, errors may occur from time to time. If we discover an error in the price of the LEGO Goods you have ordered, we will inform you as soon as possible and give you the option of reconfirming your order at the correct price or cancelling it. If we are unable to contact you we will treat the order as cancelled. If you cancel and you have already paid for the LEGO Goods, you will receive a full refund.

Delivery costs are as stipulated in the Delivery section below.

 

Payment

The hold will be removed after a number of days (to be determined by your banking institution). You will not be charged for the LEGO Goods that you have ordered until they have been despatched, unless placing a pre-order (in which instance your card will be charged at a time up to ten days after your order was made) and the estimated delivery will be indicated on the order confirmation.

The LEGO Education payment solution is based on the SSL standard, which means that your information submitted in connection with the payment transaction is protected by encryption.

-Invoice

For fax orders, email orders, postal orders, or businesses ordering LEGO Goods on the LEGO Education Europe website, our payment terms are thirty days from invoice date.

LEGO Education reserves the right to require payment in advance of despatch of orders. LEGO Education will notify you in writing if LEGO Education requires prepayment in relation to an order. If pre-payment applies, delivery of orders will be made within 7-10 working days (for items that are in stock) from date of payment clearance. If payment has not been received within 30 days of the order being placed, the order will be cancelled (to release stock).

The invoice number must be clearly stated in connection with every payment.

You must submit claims in relation to any apparent errors in LEGO Education’s invoice, such as, but not limited to pricing and/or payment terms, within ten working days from receipt of the relevant invoice.

To the extent that delivery may be postponed or delayed due to circumstances for which you are to blame (claimant’s default), you shall be required to pay the sums payable for that order as if delivery had actually taken place at the time initially agreed. Similarly, you shall bear any additional costs attributable to the delay or postponement, including but not limited to carrier and warehousing costs.

If any sum payable by you to LEGO Education is not paid in full on or before the due date, LEGO Education shall be entitled to interest on the amount not paid at the rate specified in the Late Payment of Commercial Debts (Interest) Act 1998, both after as well as before judgment or order, calculated from the due date until the date that payment is actually received by LEGO Education. In such cases, LEGO Education shall also have the right to stop or suspend the delivery of LEGO Goods to you, including any LEGO Goods already en-route to you, while any sum is overdue for payment.

For payments on account, LEGO Education will send a maximum of three payment reminders before debt is collected.

Unless otherwise expressly agreed by LEGO Education in writing, you shall not be entitled to set off against any liabilities owed by you to LEGO Education any amounts owed or claimed by you to be owed to you by LEGO Education.

At the sole discretion of LEGO Education, credit may be withdrawn from any customer who fails to meet agreed payment terms without prior agreement, until such time as the outstanding amounts are paid in full and a satisfactory assurance provided by you that the payment terms will be met in the future. Credit may be at the sole discretion of LEGO Education and can also be withdrawn from any customer in relation to whom LEGO Education is unable to obtain satisfactory credit insurance.

 

LEGO Education may prior to receipt of payment for such order, suspend or cancel any accepted order from a customer, which LEGO Education reasonably believes to be unable to pay it’s debts as they fall due.

Delivery

 

- Destinations

Delivery is only made to addresses in the United Kingdom (excluding Jersey, Guernsey or Gibraltar). If you would like delivery to be made to an address in the Channel Islands, please contact us for a quote, as extra costs not mentioned herein may be included.

If no one is available at your address to take delivery, the courier will make up to two more attempts to deliver the LEGO Goods. If, after the second attempt, the courier was unable to deliver the LEGO Goods, a notice will be left on your premises requesting you to contact the courier and arrange a new delivery. If you do not contact the courier, or the courier is unable to deliver the LEGO Goods because you are not available, the LEGO Goods will be returned to a LEGO Education warehouse, in which case, please contact us to rearrange delivery.

We cannot accept orders for delivery to PO Box addresses.

The LEGO Goods will remain at our risk until the LEGO Goods are available for unloading at your premises; so unloading is at your risk. 

Ownership of the LEGO Goods will only pass to you when we receive full payment of all sums due in respect of the LEGO Goods, including delivery charges.

 

 

- Delivery Times

- Delivery Charges for non-physical products or services

You must provide an email address if ordering digital software. Please secure that the digital content purchased is compatible with the operating platform used by you. For more information about compatibility, please go to the ‘features & specs’ tab on the LEGO Education website, or call Customer Service.

 

-       Delivery Charges for physical products

Unless otherwise agreed in writing by the parties, the manner of the delivery shall be in the sole discretion of the company performing the delivery.

The date of dispatch shall be such day on which the product is handed over by LEGO Education to the carrier.

 

- Liability for delay of delivery

LEGO Education makes every effort to deliver LEGO Goods within the estimated timescales; however delays are occasionally inevitable due to unforeseen factors. If LEGO Education does not deliver the LEGO Goods within the estimated timescales, LEGO Education shall attempt to make the delivery within an additional period of time appropriate to the circumstances. If LEGO Education fails to deliver the LEGO Goods within that additional period of time, you shall be entitled to terminate the contract.

 

- Liability for damage during transport

LEGO Education has the risk and liability for damage to the goods during transport when delivering until you or someone appointed by you have taken physical possession of the goods.

 

 

- Liability for return of LEGO Goods

If you choose to return the LEGO Goods, you will have the risk and liability for damage to the LEGO Goods during transport when returning until LEGO Education has taken physical possession of the LEGO Goods (regardless of the situation), and you will pay the cost of returning the goods.

 

RETURNS/REFUSALS

 

Except in case of defects in the LEGO Goods (see below for more information about defects), you shall not be entitled to return LEGO Goods to LEGO Education. Unauthorised returns will not be credited to you.

All LEGO Goods returned to LEGO Education must be returned in the original packaging and unless otherwise agreed by LEGO Education in writing must be shipped at your risk and cost by a carrier nominated by LEGO Education.

Returned LEGO Goods must have a return label attached as instructed by LEGO Education. If a return label is not attached to the LEGO Goods the returned LEGO Goods will not be credited by LEGO Education and LEGO Education shall accept no liability for any losses incurred by you by your failure to attach such label.

 

DEFECTS

You shall inspect or arrange for the inspection of the LEGO Goods immediately upon delivery in order to discover any defects and/or discrepancies between the quantity stated in the delivery note and quantity actually delivered. Any defects and/or discrepancies shall be noted by you on the delivery note and you shall notify LEGO Education in writing of the same within five working days after the delivery date, specifying the defects and/or any other discrepancies.

If the LEGO Goods have any hidden defects, you shall notify LEGO Education, in writing, of the same within five working days after the date upon which such defect became (or should have become) apparent, subject always to submitting any such claim no later than six months after the delivery date. If you submit no such claim, or if the LEGO Goods prove to be defective with defects that should have been ascertained during inspection, you shall forfeit the right to any compensation and/or to cancel the order.

LEGO Education (at the sole discretion of LEGO Education) shall be entitled to remedy the defect or replace the defective or missing LEGO Goods within fourteen working days of receipt of notice from you.

If you give notice to LEGO Education of any defect or discrepancy within the timeframe specified above and LEGO Education fails to remedy the defect or replace the defective or missing LEGO Goods within the period specified, you shall be entitled to cancel the order pertaining to the delivery of the relevant LEGO Goods and obtain a refund of the price paid. You must give LEGO Education notice of such cancellation within ten days of the expiry of the fourteen working days deadline stated above.

 

 

 

 

Product Recall

 

As soon as you become aware of any damage to property, death or personal injury arising from any fault or defect in the materials or workmanship of the LEGO Goods, you shall:

 

a)    give LEGO Education written notice of the details of the matter;

b)    give LEGO Education access to and allow copies to be taken of any materials, records or documents as LEGO Education may require to take action under (c) below;

c)    allow LEGO Education the exclusive conduct of any proceedings and take any action that LEGO Education requires to defend or resist the matter, including using professional advisers nominated by LEGO Education; and

d)    not admit liability or settle the matter without the written consent of LEGO Education.

Electronic Communications

When visiting LEGOEducation.co.uk or sending e-mails to LEGO Education, you are communicating electronically with LEGO. LEGO Education communicates with customers by e-mail or by posting notices on the LEGO Education web-sites. For contractual purposes you consent to receive electronic communications from LEGO Education, and agree that all agreements, notices, disclosures and other electronic communications that LEGO Education provides satisfy any legal requirement that such communications be in writing. This clause does not affect any statutory rights you might have.

 

Liability

We will not be responsible for any business loss (including, but not limited to, loss of or damage to data through use of any LEGO Education web site,  loss of profits, revenue, contracts, anticipated savings, data, goodwill or wasted expenditure) or any indirect or consequential loss.  We will not be responsible for loss of earnings due to late deliveries or costs incurred for tradesmen.

We do not in any way exclude or limit our liability for:

(a) death or personal injury caused by our negligence;

(b) fraud or fraudulent misrepresentation; or

(c)  any other liability which cannot be limited or excluded by law.

Subject to the provisions contained in the rest of this section above, the total liability of LEGO Education to you in respect of all losses arising under or in connection with these T&C, whether in contract, tort (including negligence), breach of statutory duty, or otherwise, shall in no circumstances exceed the LEGO Goods purchased and paid under the relevant order.  

EVENTS BEYOND OUR REASONABLE CONTROL

We will not be held responsible for any delay or failure to comply with our obligations under these T&C if the delay or failure arises from any cause which is beyond our reasonable control. This condition does not affect your statutory rights.

 

Data Protection

 

(1) LEGO Education may save and process any data relating to you, to the extent necessary for the purpose of the execution and implementation of the sales contract and consumer and customer satisfaction surveys and as long as LEGO Education is required to keep such data in accordance with applicable law.

 

(2) LEGO Education shall have the right to submit personal data relating to you to credit agencies, to the extent necessary for a credit check, subject, however, to your consent in each individual case. LEGO Education shall not make available any personal data of you to other third parties without the express consent of you, except to the extent that a disclosure is required under applicable law.

 

(3) LEGO Education shall not be permitted to collect, submit to any third party or otherwise process personal data of you for any purpose other than those set forth in this Section.

 

 

Retention of Title and PRODUCT Resale

 

(1) We retain legal title to any product supplied by us until the purchase price (including VAT and shipping costs) for such product has been fully paid.

 

(2) You shall not be entitled to resell any products delivered by us which are under retention of title, except with our prior written consent.

 

(3) You acknowledge that you are buying the LEGO Goods for their own purpose and will not resell the LEGO Goods to any third party.

 

 

Portrayal of LEGO GOODS

Whilst every effort has been made to portray items accurately, slight variations may occur. All measurements quoted are approximate and the reproduction of colours is as accurate as photographic and publishing processes will allow. Please note there may be variations in colours dependant on the calibration and settings of individual screens. LEGO Education is not responsible for any typing errors which may occur on the website.

 

Children

LEGO Education does not sell products for purchase by children. Persons under eighteen years of age or persons who do not possess full legal capacity, may only use the LEGO Education website with the supervision and involvement of a parent or guardian and may not purchase LEGO Goods directly themselves.

 

Fair Play

Our products cannot be used for commercial purposes such as promotional campaigns, marketing and PR. Neither can we allow you to associate LEGO® parts with any other company’s name or logo. ENTIRE AGREEMENT

These T&C and our Privacy Policy constitutes the entire agreement between you and us and supersedes and extinguishes all previous agreements, promises, assurances, warranties, representations and understandings between us, whether written or oral, relating to their subject matter.

You acknowledge that in entering into these T&C you do not rely on any statement, representation, assurance or warranty (whether made innocently or negligently) that is not set out in these T&C or any document expressly referred to in them.

You and we agree that neither of us shall have any claim for innocent or negligent misrepresentation based on any statement in these T&C.


Severability

Should any part of these T&C be deemed unlawful and invalid and thus not enforceable, this will not affect the validity and enforcement of the remainder of the T&C.


ASSIGNMENT

We may transfer our rights and obligations under these T&C to another organisation, but this will not affect your rights or our obligations under these T&C.

NO WAIVER

If we fail to insist that you perform any of your obligations under these T&C, or if we do not enforce our rights against you, or if we delay in doing so, that will not mean that we have waived our rights against you and will not mean that you do not have to comply with those obligations.


Governing law and jurisdiction

These T&C are governed by and construed in accordance with English law under exclusion of the UN Convention on the International Sale of Goods (CISG), without prejudice to any mandatory conflict of laws provision.

 

AMENDMENTS TO THESE T&C

We amend these T&C from time to time.  Every time you wish to order LEGO Goods, the T&C in force at the time of your order will apply to the contract between you and us.

These T&C were most recently updated June 2016.

The maximum quantity of an item that can purchased in each transaction is 99.
