Terms and Conditions of Sale [Consumers]

These Terms and Conditions apply to all product or service orders placed by you using web, tablet, phone, fax, postal or PO methods and fulfilled by LEGO Brand Retail, Inc. DBA LEGO Education US, 501 Boylston Street Suite 4103, Boston, Massachusetts, United States (hereinafter referred to as “LEGO Education”). These Terms and Conditions apply to end users, such as, without limitation, parents, teachers, schools and school districts. Separate terms apply to retail customers.

How it works

Once you have ordered product or services from LEGO Education, LEGO Education or a trusted agent will send you an e-mail confirming the receipt for your payment online, details of your order and details regarding delivery, provided that you submitted an accurate e-mail address when placing your order. We cannot guarantee that all the ordered goods are available in our inventory at all times but we will ship these as soon as possible.

If you have requested delivery to a different address, prices will not be included on the in-parcel receipt since we assume that the delivery shall be a gift to the recipient. Your pricing information will however be included on your order receipt email.

If an order raises security concerns, LEGO Education reserves the right to hold or cancel an order without a prior notice or explanation.

We encourage you to print or save a copy of these Terms and Conditions, your payment information for paying online and shipping confirmation e-mail immediately upon receipt, in case you need to contact us with any questions about your order. If you notice that any of the information emailed to you is incorrect, please Contact Us immediately so we can correct it. Prices

All prices stated are exclusive of all applicable taxes, and all shipping and handling fees. LEGO Education does not offer refunds for sales taxes or other taxes paid on orders. If you purchase product on shop.education.lego.com, the applicable price is the price set out next to the product in question on the website on the date of ordering. While we try and ensure that all prices on our website are accurate, errors may occur. If we discover an error in the price of goods you have ordered we will inform you as soon as possible and give you the option of reconfirming your order at the correct price or canceling it. If we are unable to contact you we will treat the order as cancelled. If you cancel and you have already paid for the goods, you will receive a full refund. Delivery costs are as stipulated in the Shipping Rates page and will be added to all orders.

Payment

Credit/Debit card
We accept payment by MasterCard, and Visa. If LEGO Education will process your transaction, your credit/debit card will be pre-authorized for payment at the time of ordering. As part of this authorization process, your bank will place a hold on your account for the purchase amount of the order. The hold will be removed after a number of days determined by your banking institution. You will not be charged for the items until they have been shipped.

The LEGO Education payment solution is based on the SSL standard, which means that your information submitted in connection with the payment transaction is protected by encryption.

Delivery is only made to addresses in the United States.

Shipping Restrictions

In order to protect our customers and maintain our commitment to service excellence, we do not ship to Freight Forwarding Services.

Delivery Times, Fees and Processes

Liability for delay of delivery

LEGO Education makes every effort to deliver goods within the estimated timescales; however delays are occasionally inevitable due to unforeseen factors. If LEGO Education does not deliver the goods within the estimated timescales you call upon LEGO to make the delivery within an additional period of time appropriate to the circumstances. If LEGO fails to deliver the goods within that additional period of time, you shall be entitled to terminate the contract.

Liability for damage during transport

LEGO Education has the risk and liability for damage to the goods during transport when delivering until you or someone appointed by you have taken physical possession of the goods. If you choose to return the goods regardless of the situation you will have the risk and liability for damage to the goods during transport when returning until LEGO Education has taken physical possession of the goods.

Right of withdrawal

You have the right to withdraw from this contract within 90 days without giving any reason. The withdrawal period will expire after 90 days from the day on which you acquire, or a third party other than the carrier and indicated by you acquires, physical possession of the first good.

To exercise the right of withdrawal, you must inform LEGO Education at the address given bellow of your decision to withdraw from this contract by an unequivocal statement (e.g. contacting customer services).

To meet the withdrawal deadline, it is sufficient for you to send your communication concerning your exercise of the right of withdrawal before the withdrawal period has expired.

Effects of withdrawal

If you withdraw from this contract, we shall reimburse to you all payments received from you, including the costs of delivery (with the exception of the supplementary costs resulting from your choice of a type of delivery other than the least expensive type of standard delivery offered by us), without undue delay and in any event not later than 14 days from the day on which we are informed about your decision to withdraw from this contract. We will carry out such reimbursement using the same means of payment as you used for the initial transaction, unless you have expressly agreed otherwise; in any event, you will not incur any fees as a result of such reimbursement. We may withhold reimbursement until we have received the goods back or you have supplied evidence of having sent back the goods, whichever is the earliest. The returned goods must be substantially the same condition and quantity as delivered by LEGO Education.

Extended right of withdrawal

In addition to your right of withdrawal as mentioned above you can withdraw from this contract within 90 days from the day on which you acquire, or a third party other than the carrier and indicated by you acquires, physical possession of the first good. The extended right of withdrawal begins 14 days after the day on which you acquire, or a third party other than the carrier and indicated by you acquires, physical possession of the first good. The extended right of withdrawal expires 90 days after the day on which you acquire, or a third party other than the carrier and indicated by you acquires, physical possession of the first good.

Effects of extended withdrawal

If you withdraw from this contract using your extended right of withdrawal, we shall reimburse to you all payments received from you, including the costs of delivery, without undue delay and in any event not later than 14 days from the day on which we are informed about your decision to withdraw from this contract. Exceptions from the right of withdrawal

The right of withdrawal in any event does not apply to goods made to the consumer´s specification i.e. non-prefabricated goods made on the basis of and individual choice of or decision by the consumer.

Complaints

Any complaints will be handled by our customer service in accordance with the relevant national legislation. You can raise a complaint by following the instructions detailed under the “How to contact LEGO Education” section.

Defective items

If any errors or defects should occur with LEGO Education products, you may claim remedy in accordance with statutory law on the sale of consumer goods. Please note the special rules regarding damage claims stipulated in the previous clause.

Electronic Communications

When visiting legoeducation.us or sending LEGO e-mails, you are communicating electronically with LEGO Education. LEGO Education communicates with the Customer by e-mail or by posting notices on the web-site. For contractual purposes you consent to receive electronic communications from LEGO Education, and agree that all agreements, notices, disclosures and other electronic communications that LEGO Education provides satisfy any legal requirement that such communications be in writing. This clause does not affect any statutory rights you might have.

Liability

TO THE FULLEST EXTENT ALLOWED BY LAW, LEGO EDUCATION’S RESPONSIBILITY FOR DEFECTIVE PRODUCTS IS LIMITED TO REPAIR, REPLACEMENT OR REFUND AS DESCRIBED IN THESE TERMS AND CONDITIONS, AND LEGO EDUCATION’S LIABILITY WILL UNDER NO CIRCUMSTANCES EXCEED THE ACTUAL AMOUNT PAID BY YOU FOR THE DEFECTIVE PRODUCT OR SERVICE THAT YOU HAVE PURCHASED, NOR WILL LEGO EDUCATION UNDER ANY CIRCUMSTANCES BE LIABLE TO YOU OR ANY THIRD PARTY FOR ANY CONSEQUENTIAL, INCIDENTAL, SPECIAL OR PUNITIVE DAMAGES OR LOSSES, WHETHER DIRECT OR INDIRECT.

For the avoidance of doubt, the foregoing shall not preclude your recovery of damages for personal injury, loss or damage to personal property, or unauthorized use or disclosure of personally identifiable information caused by our negligence, gross negligence, recklessness, fraud or other willful, unconscionable or intentional misconduct. Nothing herein shall be construed to limit the clearly established legal right of a consumer to recover attorneys’ fees or other remedies afforded by statute or other law.

Portrayal of Product

While every effort has been made to portray items accurately, slight variations may occur. All measurements quoted are approximate and the reproduction of colors is as accurate as photographic and publishing processes will allow. Please note there may be variations in colors dependent on the calibration and settings of individual screens. LEGO Education makes reservations for any typing errors which may occur on the website.

Children

LEGO Education does not sell products for purchase by children. Persons under 18 years of age or persons who do not possess full legal capacity may only use LEGO Education website with a supervision and involvement of a parent or guardian and may not purchase goods directly themselves.

Severability clause

Should any part of these Terms and Conditions be deemed unlawful and invalid and thus not enforceable, this will not affect the validity and enforcement of the remainder of the Terms and Conditions.

Retailers/businesses

These Terms and Conditions only apply to consumers and do not apply to retailers or business owners/companies. LEGO Education defines retailers or business owners/companies as those who place orders where the items/products cannot be expected to be ordered for personal use. In these circumstances LEGO Education can cancel the order without being liable in any way.
You represent and warrant that you are not buying LEGO Education products or services for the purpose of resale or export. LEGO Education products or services must not be used for commercial purposes such as promotional campaigns, marketing or public relations.

Governing law and jurisdiction

These Terms and Conditions and all matters arising out of or relating to these Terms and Conditions are governed by, and construed in accordance with, the laws of the State of New York, United States of America, without regard to the conflict of law provisions thereof to the extent such principles or rules would require or permit the application of the laws or any jurisdiction other than those of the State of New York. As you are contracting as a consumer, this will not affect your statutory rights.
